There is a story behind the story regarding the November 30 incident that left Fairview City Recorder Brandy Johnson suspended with pay and facing an assault charge.
Based on an Affidavit of Complaint related to the charge, Johnson is accused of assault by newly-elected Mayor Lisa Anderson. The affidavit also reveals the reason behind Johnson’s suspension.
According to Anderson’s statement in the affidavit, she was in a meeting with Interim City Manager Tom Daugherty on the afternoon of November 30. At some point near the end of the meeting, Daugherty stepped out of his office and observed a cell phone laying on a counter just outside his office. When Daugherty picked up the cell phone, he discovered it was in recording mode and determined the phone to belong to Johnson.
Daugherty immediately notified the Fairview Police Department of his finding and Cpl. Jamey Meadows responded to city hall to investigate. A few minutes after Meadows arrived to Daugherty’s office, Johnson walked up and accused Anderson of taking her cell phone.
After Anderson stated she did not have the cell phone, Johnson “became more irritable and angry” towards Anderson. When Johnson lunged toward Anderson, Cpl. Meadows intervened to stop Johnson.
At the time of the incident, Johnson was placed on suspension with pay pending an investigation into the cell phone recording by the Tennessee Bureau of Investigations.
Tennessee is a one-party consent state, meaning it is a criminal offense to use any device to make a recording of a conversation that you are not taking a part in. The law states it is illegal to leave a recording device in a room after you leave to record a conversation you are not part of.
Recording such a conversation in violation of Tennessee law is considered a felony.
After the incident, Johnson was also charged with a state criminal offense and issued a summons to report the Williamson County Sheriff’s Office for booking on the charge of assault. Tennessee law defines assault as intentionally or knowingly causing another to reasonably fear imminent bodily injury.
